These Terms constitute a legally binding agreement between you and Marple Capital Institutional B.V. ("Marple Capital," "we," "us," or "our").
You must be at least 18 years of age and have the legal capacity to enter into binding agreements to use the Platform. By using the Platform, you represent and warrant that you meet these eligibility requirements. We reserve the right to restrict access to the Platform based on your jurisdiction, residency, or other applicable legal requirements.
To access certain features of the Platform, you must register for an account. You agree to provide accurate, current, and complete information during registration and to keep your account information up to date. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
Marple Capital provides a digital asset trading platform that enables users to trade cryptocurrencies, stock tokens, commodities, forex, and other financial instruments. The Platform may include features such as spot trading, perpetual futures, staking, AI-powered trading signals, and portfolio management tools.
Trading digital assets and financial instruments involves substantial risk of loss and is not suitable for all investors. The value of assets can fluctuate significantly, and you may lose some or all of your investment. Past performance is not indicative of future results. You should carefully consider your investment objectives, level of experience, and risk appetite before making any investment decisions.
The Platform charges fees for certain services, including trading fees, withdrawal fees, and other applicable charges. Fee schedules are published on the Platform and may be updated from time to time. By using the Platform, you agree to pay all applicable fees.
You agree not to use the Platform for any unlawful purpose or in violation of any applicable laws or regulations. Prohibited activities include but are not limited to: money laundering, terrorist financing, fraud, market manipulation, insider trading, and any activity that could harm the integrity of the Platform or its users.
All content, trademarks, logos, and intellectual property on the Platform are owned by or licensed to Marple Capital. You are granted a limited, non-exclusive, non-transferable license to access and use the Platform for personal, non-commercial purposes.
To the maximum extent permitted by applicable law, Marple Capital shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising out of or in connection with your use of the Platform.
You agree to indemnify, defend, and hold harmless Marple Capital, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with your access to or use of the Platform or your violation of these Terms.
We may terminate or suspend your account and access to the Platform at any time, without prior notice or liability, for any reason, including but not limited to a breach of these Terms. Upon termination, your right to use the Platform will immediately cease.
These Terms shall be governed by and construed in accordance with the laws of the Netherlands, without regard to its conflict of law provisions. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Amsterdam, the Netherlands.
We reserve the right to modify these Terms at any time. We will notify you of any material changes by posting the updated Terms on the Platform and updating the "Last Updated" date.
